What are the Travelers' auto insurance accidents & violations?
Incidents are accumulated using the driving incident records for each eligible driver in the household. The provisions of this rule shall be on an operator/per-vehicle basis.
Incident Types
Convictions
Convictions include those categorized below for all Eligible Drivers in the household.
Major Convictions
- Driving under the influence: driving while intoxicated or under the influence of drugs
- Attempting to elude officer: eluding or attempting to elude a police officer
- Failure to stop/report an accident: failure to stop and report when involved in an accident
- Gross negligence/manslaughter: homicide or assault arising out of the operation of a motor vehicle
- Illegal use of license/driving while suspended: driving while license is suspended or revoked; using a stolen license
- Operate without owner’s permission: operating a motor vehicle without the owner's permission
- Loan license to an unlicensed person
- Reckless driving: driving a motor vehicle in a reckless manner
- Speeding: more than 100 miles per hour
- Racing: engaging in a speed contest
- Suspension/Revocation: suspension or revocation of a license as a result of a conviction
- Any other 2-point major convictions
Minor Convictions
- Speeding other than over 100 miles per hour
- Stop sign and traffic signal violations
- Improper turn or lane changes
- Miscellaneous Minor Violations are assigned one or more points by the California Department of Motor Vehicles.
- Any other 1-point minor conviction
Accidents
Accidents include the following:
- At-fault accidents:
Accidents involving any Eligible Driver who was at least 51% at fault, while operating an auto and resulting in a loss causing bodily injury, or death. or damage to any property over $1,000, unless categorized below as Not-At-Fault.
- Not-At-Fault Accidents
- Accidents incurred by an operator demonstrated to be a named insured or operator of an auto insured under a separate policy; and
- Accidents occurring under the following circumstances:
- auto lawfully parked (if the vehicle rolls from the parked position then any such accident is charged to the person who parked the auto); or
- the applicant, owner, or other resident operator is reimbursed by, or on behalf of a person who is responsible for the accident or has a judgment against such person; or
- auto operated by the applicant or any resident operator (1) which is struck in the rear by another vehicle and the insured has not been convicted of a moving traffic violation in connection with this accident; (2) which is struck by a "hit-and-run" vehicle, if the accident is reported to the proper authority within 24 hours by the applicant or resident operator; or
- operator of the other auto involved in the accident was convicted of a moving traffic violation and the applicant or resident operator was not convicted of a moving traffic violation in connection with the accident, or
- accidents occurring when using auto in response to an emergency if the operator of the auto at the time of the accident was a paid or volunteer member of any Police or Fire Department, First Aid Squad, or any law enforcement agency. This exception does not include an accident occurring after the auto ceases to be used in response to such an emergency.
- applicant, owner, or other resident operator receives payment solely under Medical Payments, Uninsured Motorists, or Underinsured Motorists Coverages, and the operator was not convicted of a moving traffic violation.
- Comprehensive Losses
- Accidents involving Comprehensive Loss Payments Only
- Accidents involving Physical Damage caused by contact with animals or fowl; or
- Accidents involving Physical Damage, limited to and caused by flying gravel, missiles, or falling objects.
- All other loss activity not classified above as an Accident.
